Decisions of Jilin Provincial People's Government on the Revision of Such Regulations as the Provincial Government as the Measures of Jilin Provincial People's Government on the Protection of Broadcast and Television Facilities and Others

(Promulgated by Decree No. 160 of the Jilin Provincial People's Government on May 24, 2004)

 

　　In order to carry out and implement the Law of Administrative License, facilitate the citizens, corporations and other organizations to handle administrative licenses, according to the stipulations of the Law of Administrative License that the administrative licensing items must possess the licensing implementation organs, terms, procedures and time limits, the provincial government has determined to revise the Measures of Jilin Provincial People's Government on the Protection of Broadcast and Television Facilities ,the Measures of Jilin Province on Slaughtering Domestic Animals and Birds, and the Measures of Jilin Province on the Administration of the License for Charges as follows:

　　First, Two articles shall be added after Article 17 as Articles 18 and 19 in the Measures of Jilin Provincial People's Government on the Protection of Broadcast and Television Facilities. Article 18: " The following conditions must be conformed when transfer, buy and sell the state- invested or collectively- built broadcast and television facilities: (1) broadcast and television facilities are obtained by law; (2) the set-up broadcast and television facilities conform to the state construction plan, technological development plan and technical standards for broadcast and television; (3) the transferring units or buying units have been inserted into the regional broadcast and television transmission net." Article 19: "The conditions in the provisions of Article 18 must be conformed when transfer, buy and sell state-invested or collectively-built broadcast and television facilities, and an application should be applied to the site administrative departments of broadcast and television at the county level and upwards; as for the application of transferring, buying and selling broadcast and television facilities, the administrative departments of broadcast and television at the county level and upwards, which receive the applications, should examine them according to the conditions stipulated in Article 18, and handle and finish them within 20 days. Those conforming to the conditions shall be rendered a verification; those failing to conform to the conditions shall not be rendered a verification, and inform the applicants in a written form. The original Article 18 "As for the government-invested or collectively-built broadcast and television facilities, any unit or individual has no right to transfer, buy and sell and close them down without the approval of the administrative departments of broadcast and television at higher levels." shall be counted as Article 20, and shall be revised as : " As for the government-invested or collectively-built broadcast and television facilities, any unit or individual has no right to transfer , buy and sell and close them down without the approval of the administrative departments of  broadcast and television at the county level and upwards."

　　Second, The Article 12 Item 1 of the Measures of Jilin Province on the Management of Butchering Beasts and Birds:  A finishing-examination stamp of inspection shall be sealed on beasts-bird products up to their meat quality by fixed slaughter houses (fields) of beasts and birds, and a certification of examination of product inspection shall be provided. The unqualified products of beasts and birds shall be handled by the slaughter houses (fields) under the supervision of the personnel of meat quality inspection in accordance with relevant state regulations. Whichever has not been inspected or fail to pass the inspection of products on quality shall not be allowed to be transported out of the factory (field)."shall be revised as : " A finishing- examination stamp of inspection shall be sealed on the beast-bird products up to the meat quality by fixed slaughter houses (fields) of beasts and birds within the very day and a certification of inspection of products shall be provided. The unqualified products of beasts and birds shall be handled by the slaughter houses (fields) under the supervision of the personnel of meat quality examination in accordance with relevant state regulations. Whichever has not been inspected or fail to pass the inspection of products on quality shall not be allowed to be transported out of the factory (field).

　　Third, in the Measures of Jilin Province on the Administration of the License on Charges, two articles shall be added after Article 12 as Articles 13 and 14. Article 13: "The following conditions should be possessed when applying for Toll Collector's Certification: (1)to have  application form of Toll-Collector's  Certification (the opinion of the charging unit and the seal of its principle leader and the official seal  of the charging unit must be stamped on the form;)(2)to have I.D.s (copies of their ID cards ) of the persons  who apply to  Toll-Collector Certifications; (3)to have the policy basis of participating in the concrete charging work and the identification of the charging unit;(4)other files and materials which can prove that they can take their Toll-Collector's Certifications in the flesh. Article 14:" The following procedures shall be accorded in applying to Toll-Collector's Certifications:(1)the applicants should go to their competent administrative departments of price, which issue Toll-Collector's Certifications, to get Application Form of Toll-Collector's Certifications in duplicate, and fill in item by item according to the form and should offer the required materials of the application form;(2)the official seals of their charging units shall be stamped on their application forms which have been well filled in and the persons in charge shall sign and confirm;(3)as for the application of the applicant, the competent administrative department of price shall finish examination within 20 workdays according to the conditions stipulated in these Measures. Whichever conform to the conditions shall be issued licenses; Whichever do not conform to the condition shall not be issued licenses and a written information shall be delivered to the applicants. The longest period of validity of Toll-Collector's Certification can't exceed 3 years. "

 

 

吉林省人民政府关于修改《吉林省广播电视设施保护办法》等省政府规章的决定

（吉林省人民政府令第160号2004年5月24日）

　　为贯彻实施《行政许可法》，便于公民、法人和其他组织办理行政许可，根据《行政许可法》关于行政许可事项必须具备许可的实施机关、条件、程序和期限的规定，省政府决定对《吉林省广播电视设施保护办法》、《吉林省畜禽屠宰管理办法》、《吉林省收费许可证管理办法》作如下修改：

　　一、在《吉林省广播电视设施保护办法》第十七条之后，增加两条，作为第十八条和第十九条。第十八条：“转让、买卖国家投资或集体兴建的广播电视设施，必须符合下列条件：（一）广播电视设施是依法取得的；（二）设置广播电视设施符合国家的广播电视建设规划和技术发展规划及技术标准；（三）接受转让的单位或买方单位已经接入区域性广播电视传输网。”第十九条：“转让、买卖国家投资或集体兴建的广播电视设施，必须符合本办法第十八条规定的条件，并向所在地县级以上广播电视管理部门提出申请，接到申请的县级以上广播电视管理部门，对于转让、买卖广播电视设施的申请，应当按照本办法第十八条规定的条件进行审查，并在20日内办理完结。符合条件的，予以批准；不符合条件的，不予批准，并书面通知申请人。”将原第十八条：“国家投资或集体兴建的广播电视设施，未经上级广播电视主管部门批准，任何单位或个人都无权转让、买卖和查封。”作为第二十条，修改为：“国家投资或集体兴建的广播电视设施，未经县级以上广播电视主管部门批准，任何单位或个人都无权转让、买卖和查封。”

　　二、将《吉林省畜禽屠宰管理办法》第十二条第一款：“畜禽定点屠宰厂（场）对肉品品质检验合格的畜禽产品应当加盖检验合格的验讫印章，并出具产品检验证明。检验不合格的畜禽产品，应当在肉品品质检验人员的监督下，由厂（场）方按照国家有关规定进行处理。未经肉品品质检验或者经肉品品质检验不合格的产品，不得出厂（场）。”修改为：“畜禽定点屠宰厂（场）对肉品品质检验合格的畜禽产品应当在当日内加盖检验合格的验讫印章，并出具产品检验证明。检验不合格的畜禽产品，应当在肉品品质检验人员的监督下，由厂（场）方按照国家有关规定进行处理。未经肉品品质检验或者经肉品品质检验不合格的产品，不得出厂（场）。”

　　三、在《吉林省收费许可证管理办法》第十二条之后增加两条作为第十三条、第十四条。第十三条：“申领《收费员证》应当具备下列条件：（一）有《收费员证》申请表（表上应有收费单位的意见，加盖主要领导名章和收费单位公章）；（二）有申领《收费员证》人员的身份证明（身份证复印件）；（三）有从事具体收费工作的政策依据及收费单位的证明；（四）其他能证明本人可领取《收费员证》的文件、资料”。第十四条：“申领《收费员证》按下列程序进行：（一）申领人到发放《收费员证》的价格主管部门领取《收费员证申请表》一式两份，按表列内容逐项填写并提供申请表所要求的资料；（二）将填写好的申请表加盖本单位公章，负责人签名确认；（三）价格主管部门对于申领人提出的申请，应当按照本办法规定的条件在20个工作日内审查完结。符合条件的，予以发证；不符合条件的，不予发证，并书面通知申请人。《收费员证》的最长有效期不得超过3年。”
