Measures of Jilin Province on Slaughtering Domestic Animals and Birds

  Article 1. These Measures are formulated for the purposes of strengthening the management of slaughtering domestic animals and birds, keeping the quality of the products from them and the guarantee of the public health, in accordance with the State Council's Management Regulations on Slaughtering Live Pig (hereinafter referred to as "Regulations") and relevant laws and regulations, and in the light of the actual conditions of this province.

  Article 2. These Measures apply to the domestic animals and birds slaughtering and related activities within the provincial administrative division.

  Article 3. The domestic animals and birds in these Regulations refer to pigs, cattle, sheep, horses, mules, donkeys, dogs, chickens, ducks and gooses.

       The products from them in these Regulations include the body, meat, fat, internal organs, blood, bones, heads, hoof, skin and etc. after slaughtering and before processing.

  Article 4. The administrative departments in charge of commodity circulation of the people's governments at county level and upwards must be in charge of the management work of domestic animals and birds slaughtering industry, conduct the supervision work on the slaughtering according to law, and also carry out these Measures.

  Animal husbandry, industrial and commercial, taxation, public security, sanitation, environmental protection, price, technological supervision and the other organizations must do their own duties and cooperate with the administrative department which is in charge of commodity circulation to undertake slaughtering and its products management.

  Article 5. The appointed places policy is implemented in the domestic animals and birds slaughtering industry. The slaughtering activities must be carried out within the government-approved slaughterhouses. Any institution and individual may not carry out the slaughtering in the slaughter house, which is not approved by government except the slaughtering for self-eating.

  Article 6. The setting-up appointed slaughterhouses must be far away from the protective area of water sources on the earth's surface for living use and not influence and obstruct the local residents' living and public activities. Also it should have the following conditions:

       (1)Having enough water sources corresponding to its slaughtering capacity, and the water quality conforming to national standards.

       (2)Having pre-slaughtering shop, slaughtering shop, quickly slaughtering shop, slaughtering facilities and transportation vehicles conformed to the requirement of national regulations.

       (3)Having slaughtering technicians who have healthy certificate according to law.

       (4)Having enough full-time or part-time QC personnel who have passed the examinations carried out by the provincial administrative authority in charge of commodity circulation, and who must fit in with the slaughtering capacity.

       (5)Having necessary testing equipments, freezing storage installations, sterilizers and disinfectant, and pollutant treating equipments.

       (6)Having innocuous treating facilities for domestic animals and birds and their products.

       (7)Having epidemic prevention conditions conforming to the Articles regulated in the animal epidemic prevention laws. and

       (8)Conforming to the requirement of the Establishing Plan on Domestic Animals and Birds Appointed Slaughterhouses of Jilin Province.

  Article 7. The establishment of appointed slaughterhouses is required to make full use of the existing slaughter facilities and conditions conforming to the standards, and prevent reconstruction.

  Article 8. To apply for setting up slaughterhouses must submit the written applications and relative documents to the city or county administrative authority in charge of commodity circulation of the local people's government. The administrative authority must carry out auditing together with related departments within 15 days since receiving the application. In regard to the applications which are meeting the requirement, they should be reported to the people's government at the same level to take examination and approval and issue the slaughterhouse symbol boards, which are unified numbers and made by the competent administrative authority in charge of commodity circulation.

  Article 9. The slaughtered domestic animals and birds in the appointed places must have quarantine-qualified certification issued by epidemic prevention supervision organs of domestic animals and birds source area. The slaughtering quarantine shall be carried out by the local epidemic prevention supervision organs of domestic animals and birds. Of which, the quarantine of the state appointed self-quarantine slaughterhouse and meat allied factory shall be carried out by themselves and the epidemic prevention supervision organs shall be responsible for supervision.

  Article 10. As to the quarantine-qualified products from the domestic animals and birds, they must be issued quarantine certifications by epidemic prevention supervision organs and be stamped examined symbol. The unqualified products after quarantine, they must be treated to be innocuous or destroyed.

  Article 11. The appointed slaughterhouses must set up a complete meat product quality examining system, the examining system includes the follows:

  (1)The diseases beyond infectious diseases and verminosis;

  (2)Harmful glands;

  (3)Slaughtering and processing quality;

  (4)Injecting water or other substances;

  (5)Harmful substances; and

  (6)Breed boar or sow and overage hog.

  The examination of the meat products quality must be carried out at the same step with domestic animals and birds slaughtering. The examination must be true and careful, the result must be registered. The registered documents must be filed well for later checking.

  Article 12. The appointed domestic animals and birds slaughterhouses must stamp examined seal on qualified meat products and issue examination certifications within the same day. The unqualified meat products must be handled according to the related regulations and under the supervision of QC personnel. The products without examination or unqualified must not be transported out of the factory.

  All of the breed boars or sows and overage hogs must be treated as the raw materials for cooked food and must not sell as fresh meat.

  Article 13. The products of domestic animals and birds entering the market must have quarantine certifications and examined stamps, which are issued by the epidemic prevention supervision organs; at the same time, they also must have examined stamps and the qualified certifications.

Article 14. The domestic animals and birds slaughtered in appointed slaughterhouses must not be injected water or other substances.

Article 15. In regard to the products, which are not sold in time or transported out of factory on time, the appointed domestic animals and birds slaughterhouses must adopt freezing or cold storage methods to store them.

  Article 16. The appointed slaughterhouses must use the qualified special vehicles which are conformable to the national sanitary standards when transporting domestic animals or birds or their products.

  Article 17. The appointed slaughterhouses must accept the slaughtering work from proprietors, the related fees charging standards shall follow the regulations of the price authority.

  Article 18. For the products of the appointed slaughterhouses, which conform to the regulations of said Article 13, no units or individuals must limit the circulation and carry out re-quarantine, re-examination and impose additional charge.

  Article 19. The units, individuals, restaurants, hotels and collective mess units, which undertake sales and processing of the products from domestic animals and birds, must sell or use qualified products which have passed the quarantine and examination by the appointed slaughterhouses.

  Article 20. When conducting the examination and supervision, the domestic animal-bird law enforcement officials must show the legal administrative executing certificates. They may use visual examination, sample testing, files checking, questioning, certifications checking and other ways to conduct the examinations. It's for bidden to impose any fees for the administrative examination. The examinee units and individuals must not refuse and obstacle the examination.

  Article 21. Violators of the provisions of these Measures or the conduct of slaughtering without authority permission, shall be banned by the administrative authority of the related city or county people's government which is in charge of the commodity circulation, and together with the related departments to confiscate the products and illegal incomes, and fine 1 to 2 times of the running capital. To the serious behavior, penalty can be 2 to 3 times of the running capital.

  Article 22. Against the Measures, the appointed domestic animal-bird slaughterhouses engage in the behaviors, such as injecting water or other substances into domestic animals or birds or their products, they must be ordered to stop their slaughtering activities by the related city or county administrative authority which is in charge of commodity circulation. The authority must confiscate the water-injected or other-substance-injected domestic animals, birds and their products and the illegal incomes. Meanwhile, the slaughterhouses should be given 1 to 5 times the fine of their illegal business incomes; for the serious illegal behaviors, authorized by the city or county people's government, they should be canceled the qualification of appointed slaughterhouse.

  Article 23. Against the Measures, the appointed domestic animal-bird slaughterhouses do not handle the unqualified domestic animal-bird meat products according to the related national regulations, the city or county administrative authority in charge of the commodity circulation can order them to handle these products within limited time and can also give a fine of RMB3000 to 30000; and also RMB30 thousand to 50 thousand for the serious illegal behaviors.

  Article 24. For the domestic animal-bird products entering into the market but without meat-quality examination or unqualified or being injected water or other substances, the sanitation and industrial-commercial administrative authorities can conduct the penalty separately to the responsible producers and sellers according to their respective responsibilities according to law.

  Article 25. The behavior like using the methods of violence or threatening to obstacle the examiner to conduct the legal examinations shall be punished by the public security authority according to Rules of Management and Penalization for Public Order; if a crime is constituted, the offenders shall be investigated for their criminal responsibilities by the judicial office.

  Article 26.  The staff of the administrative authority in charge of the commodity circulation or other administrative law-enforce personnel, who abuse their power or neglect of duty or indulge in malpractice or ask and take bribes, shall be given disciplinary sanctions by their work units or the supervisory organ; and where a crime is constituted, the offenders shall be investigated for their criminal responsibilities by judicial office.

  Article 27.  In regard to the violators of the provisions of these Measures, any one has the right to impeach and expose them. The people with a fine record of impeaching and exposing, and the units and individuals who give outstanding contributions in the work of domestic animal-bird slaughtering, should be commended and rewarded.

  Article 28.  These Measures shall become effective as of the date of promulgation.

 

 

  吉林省畜禽屠宰管理办法

  (1999年7月9日省政府第110号令发布,根据2004年5月24日吉林省人民政府令第161号《吉林省人民政府关于修改〈吉林省畜禽屠宰管理办法〉的决定》修订)

  第一条为了加强畜禽屠宰管理,保证畜禽产品质量,保障人民身体健康,根据国务院《生猪屠宰管理条例》(以下简称《条例》)和有关法律、法规,结合本省实际,制定本办法。

  第二条本办法适用于本省行政区域内的畜禽屠宰及其相关活动。

  第三条本办法所称畜禽是指猪、牛、羊、马、骡、驴、犬、鸡、鸭、鹅。

  本办法所称畜禽产品是指屠宰后未经加工的畜禽胴体、肉、脂、脏器、血液、骨、头、蹄、皮等。

  第四条县级以上人民政府商品流通行政主管部门负责本行政区域内的畜禽屠宰行业管理工作,依法对畜禽屠宰活动进行监督管理,并负责本办法的实施。

  畜牧、工商、税务、公安、卫生、环保、物价、技术监督等有关部门应当按照各自职责,配合商品流通行政主管部门做好畜禽屠宰及其产品的管理工作。

  第五条畜禽屠宰实行定点制度。屠宰畜禽必须在政府批准的畜禽定点屠宰厂(场)内进行。未经定点的,任何单位和个人不得屠宰畜禽;但个人自宰自食的畜禽除外。

  第六条设立畜禽定点屠宰厂(场),应当远离生活饮用水的地表水源保护区,并不得妨碍或者影响所在地居民生活和公共场所的活动。同时还应当具备下列条件:

  (一)有与屠宰规模相适应,水质符合国家规定标准的水源条件;

  (二)有符合国家规定要求的待宰间、屠宰间、急宰间以及畜禽屠宰设备和运输工具;

  (三)有依法取得健康证明的屠宰技术人员;

  (四)有经省商品流通行政主管部门考核合格并与屠宰规模相适应的专职或兼职肉品品质检验人员;

  (五)有必要的检验设备、冷藏设施、消毒设施和消毒药品及污染物处理设施;

  (六)有畜禽及其产品无害化处理设施;

  (七)有符合动物防疫法规定的防疫条件;

  (八)符合《吉林省畜禽定点屠宰厂(场)设置规划》的要求。

  第七条定点屠宰厂(场)的设置要充分利用现有符合要求的屠宰设施和条件,合理确定,防止重复建设。

  第八条申请设立畜禽屠宰厂(场),应当向当地的市、县人民政府商品流通行政主管部门提交书面申请及有关资料,商品流通行政主管部门应当在接到申请之日起15日内会同有关部门进行审核。对符合条件的,报请同级人民政府审批,并颁发由省商品流通行政主管部门统一编号、制作的定点屠宰厂(场)标志牌。

  第九条畜禽定点屠宰厂(场)屠宰的畜禽,应当具有畜禽产地动物防疫监督机构出具的检疫合格证明。

  定点屠宰厂(场)的屠宰检疫由当地动物防疫监督机构实施。其中,国家确定实行自检的屠宰厂、肉类联合加工厂由厂方自行负责,动物防疫监督机构进行监督。

  第十条经检疫合格的畜禽产品,必须出具动物防疫监督机构统一制发的检疫证明,并加盖验讫标志。检疫不合格的畜禽产品,必须按国家有关规定进行无害化处理或销毁。

  第十一条畜禽定点屠宰厂(场)必须建立健全严格的肉品品质检验制度,肉品品质检验包括以下内容:

  (一)传染性疾病和寄生虫病以外的疾病;

  (二)有害腺体;

  (三)屠宰加工质量;

  (四)注水或者注入其他物质;

  (五)有害物质;

  (六)种公母猪及晚阉猪。

  肉品品质检验必须和畜禽屠宰同步进行。检验结果必须真实、详细,并进行登记,登记资料必须妥善保管备查。

  第十二条畜禽定点屠宰厂(场)对肉品品质检验合格的畜禽产品应当在当日内加盖检验合格的验讫印章,并出具产品检验证明。检验不合格的畜禽产品,应当在肉品品质检验人员的监督下,由厂(场)方按照国家有关规定进行处理。未经肉品品质检验或者经肉品品质检验不合格的产品,不得出厂(场)。

  种公母猪和晚阉猪,一律作熟食制品加工原料。不得上市鲜销。

  第十三条进入市场销售的畜禽产品,必须具有动物防疫监督机构出具的检疫证明和验讫标志;同时,还必须具有肉品品质检验验讫印章和肉品品质检验合格证明。

  第十四条畜禽定点屠宰厂(场)屠宰的畜禽不得注水或注入其他物质。

  第十五条畜禽定点屠宰厂(场)对未能及时销售或及时出厂的畜禽产品,必须采取冷冻或冷藏等必要措施予以储存。

  第十六条畜禽定点屠宰厂(场)运输畜禽及其产品必须使用符合国家卫生标准的专用运载工具。

  第十七条畜禽定点屠宰厂(场)应当接受客户委托屠宰畜禽,有关收费标准按物价部门的规定执行。

  第十八条畜禽定点屠宰厂(场)屠宰的畜禽产品,符合本办法第十三条规定的,任何单位和个人不得限制流通,也不得重复检疫检验、滥收费。

  第十九条从事畜禽产品销售、畜禽产品加工的单位和个人以及饭店、宾馆、集体伙食单位,应当销售或者使用定点屠宰厂(场)屠宰的并经检疫、检验合格的畜禽产品。

  第二十条畜禽屠宰执法监督检查人员进行执法监督检查时,必须出示合法的行政执法证件。检查时,可以采取感官检查、取样化验、查阅资料、询问、查验证件等方式。行政执法检查不得收取任何费用。被检查的单位和个人不得阻碍、拒绝检查。

  第二十一条违反本办法规定,未经定点擅自屠宰畜禽的,由市、县人民政府商品流通行政主管部门予以取缔,并会同有关部门没收屠宰的畜禽产品和非法所得,可以并处违法经营额1倍以上2倍以下的罚款;情节严重的,可以并处违法经营额2倍以上3倍以下的罚款。

  第二十二条违反本办法规定,畜禽定点屠宰厂(场)对畜禽、畜禽产品注水或者注入其他物质的,由市、县人民政府商品流通行政主管部门责令停止屠宰活动,没收注水或者注入其他物质的畜禽、畜禽产品和违法所得,可以并处违法经营额1倍以上5倍以下的罚款;情节严重的,经市、县人民政府批准,取消定点屠宰厂(场)资格。

  第二十三条违反本办法规定,畜禽定点屠宰厂(场)对肉品品质不合格的畜禽产品未按照国家有关规定处理的,由市、县人民政府商品流通行政主管部门责令限期处理,可以处3000元以上3万元以下罚款;情节严重的,可以处3万元以上5万元以下罚款。

  第二十四条市场销售的畜禽产品未经肉品品质检验或经肉品品质检验不合格的;注水或注入其他物质的,由卫生行政管理、工商行政管理等部门按照各自职责分工对负有责任的生产者、销售者依法给予处罚。

  第二十五条以暴力、威胁方法阻碍屠宰执法监督检查人员依法执行职责的,由公安机关依照治安管理处罚条例处罚;构成犯罪的,由司法机关依法追究其刑事责任。

  第二十六条商品流通行政主管部门的工作人员及其他行政执法人员滥用职权、玩忽职守、徇私舞弊、索贿受贿的,由其所在单位或者监察机关给予行政处分;构成犯罪的,由司法机关依法追究其刑事责任。

  第二十七条对违反本办法规定的,任何人都有权检举和揭发,举报有功者以及其他在畜禽屠宰工作中做出显著成绩的单位和个人,给予表彰和奖励。

  第二十八条本办法自发布之日起施行。
